Terms of Service

These Terms ("Terms") are an agreement between You and OriginMind Inc., a corporation incorporated under the Canada Business Corporations Act ("moonbelt", "We", "Us", "Our"), governing Your use of the moonbelt mobile application and related services (the "Service"). By using the Service, You agree to these Terms and Our Privacy Policy.

Language. These Terms are available in English and French. If You live in Quebec, the French version is presented to You first, and You may choose to be bound by either version. If the two versions differ, the one more favourable to You prevails.

US residents: please read Section 15 (Arbitration) carefully. It affects Your legal rights.

By accessing or using the Service, You confirm that You have read, understood, and agreed to be bound by these Terms. If You do not agree, You must stop using the Service.

3. Eligibility

You must be at least 18 years old to use the Service. By accessing or using the Service, You represent and warrant that You are 18 or older. The Service is not directed to anyone under 18, and We may suspend or terminate any account that We determine has misrepresented its age.

You should not use the Service if You are pregnant or nursing, have or are recovering from an eating disorder, or have a medical condition requiring a supervised diet, unless a physician has approved Your use.

4. Medical and Wellness Disclaimer

moonbelt is not a medical device and does not diagnose, treat, cure, or prevent any medical condition. It does not provide medical advice, diagnosis, or treatment. Calorie targets, macro splits, meal suggestions, meal plans, step counts, workout and calorie-burn figures, sleep durations and sleep stage breakdowns, trends, insights, and AI coaching content are for general wellness, informational, and educational purposes only, and are not a substitute for professional medical or nutritional guidance. Always consult a qualified healthcare professional for medical advice, diagnosis, or treatment, and never disregard or delay professional advice because of something You saw in moonbelt.

Sleep, activity, and recovery information. moonbelt displays sleep, step, and workout information that it reads from Your device's health platform, and may discuss it in coaching content. This information is not a clinical assessment and must not be used to detect, diagnose, monitor, or rule out any condition, including sleep apnea, insomnia, any other sleep disorder, a cardiac or respiratory condition, or overtraining or injury. Sleep stage breakdowns in particular are consumer-grade estimates produced by Your device, not a sleep study. If You are concerned about Your sleep, Your recovery, or symptoms such as persistent fatigue, snoring, or breathing interruptions, please see a physician or a sleep specialist rather than relying on moonbelt.

Meal plans and allergies. Meal plans are generated automatically by AI and may include foods that conflict with Your allergies, intolerances, medical conditions, or religious or ethical dietary requirements. You are responsible for reviewing every meal plan before acting on it and for confirming that each food and ingredient is safe and appropriate for You. Do not rely on a meal plan to avoid an allergen or to manage a medical condition. If You have a food allergy or a condition requiring a controlled diet, consult a qualified professional before following any plan.

Consult a physician or registered dietitian before making significant dietary changes, especially if You have a medical condition, are pregnant or nursing, or have a history of disordered eating. Results vary; moonbelt makes no guarantee of weight loss or any health outcome.

5. AI Features

moonbelt uses third-party AI, Google's Gemini models, to recognize food from photos, parse voice meal logs, generate coaching responses and nutrition insights, and create personalised meal plans. AI features send Your data to Google only after You give permission in the app, and You can withdraw that permission at any time, as described in Section 6 of Our Privacy Policy. AI output can be inaccurate or incomplete and may suggest foods that are unsuitable for You. Always review AI output, including every item in a meal plan, before relying on it. AI content is educational, not medical advice.

Personal context in coaching. So that its answers fit You, the AI coach receives information from Your account, including Your profile, food preferences, targets, recent logs, earlier messages, and, where You have enabled them, daily totals from Your step, workout, and sleep data, as described in Section 6 of Our Privacy Policy. The coach may therefore refer to Your weight, Your sleep, Your training, or a health condition You have mentioned when discussing Your nutrition. Any such comment is general wellness content, not a clinical interpretation, and Section 4 applies to it in full.

AI coach memory. The AI coach may save short notes about lasting facts You mention, such as preferences, allergies, routines, or health conditions, and use them in later conversations. These notes are generated automatically and may be incomplete, wrong, or out of date. They do not replace the allergies, intolerances, and dietary preferences You set in the app: keep those settings current, and do not rely on the coach remembering something You told it.

AI-generated content is produced automatically and may contain errors, inaccuracies, or omissions. We do not guarantee its accuracy, completeness, or fitness for any particular purpose, and You assume the risk of relying on it.

6. Data Sources and Accuracy

Nutritional information in the Service, including calories, macronutrients, micronutrients, serving sizes, and other values, is provided for general informational purposes only. It is drawn from a combination of third-party databases, public data sources, AI estimation, and information You enter.

Data sources and attribution. moonbelt's nutrition information is derived in part from the following sources:

These sources are maintained by third parties, may contain community-contributed entries, and may be incomplete, outdated, or inaccurate.

Accuracy. We do not warrant or guarantee the accuracy, completeness, or reliability of any nutritional data, calorie estimate, serving size, or portion estimate, whether sourced from a third-party database, generated by AI from a photo, voice input, or barcode, or otherwise. Values derived from photos, including identification of foods and estimation of quantities or portion sizes, are approximations and may differ significantly from actual values. You are solely responsible for evaluating the accuracy, completeness, and suitability of all nutritional information before relying on it, including verifying packaging labels, ingredients, and allergen information directly from the product or its manufacturer. You use the Service, and make dietary, nutritional, and health decisions, at Your own risk.

Health platform and device data

Third-party sources. If You grant permission, moonbelt reads step count, workout sessions, and sleep sessions from Apple HealthKit (iOS) or Android Health Connect ("Health Platforms"). Records in a Health Platform may have been written by another app, a smartwatch, or a fitness tracker. moonbelt does not generate this data, does not measure anything itself, and has no control over how the originating app or device recorded it.

Accuracy. We do not warrant or guarantee the accuracy, completeness, or reliability of any step count, workout duration, distance, energy or calorie-burn figure, sleep duration, time in bed, or sleep stage breakdown. Consumer devices estimate these values, and estimates vary between devices and can be significantly wrong. Sleep stage breakdowns and calorie-burn figures are the least reliable of them. Calories burned shown in moonbelt is an estimate derived from Your profile, Your steps, and Your workouts, and should be treated as a rough guide, not a measurement.

Availability. Health Platforms and the apps and devices that write to them are operated by third parties under their own terms, and their availability, behaviour, permissions, and data formats may change or stop working at any time without notice to Us. We may add, change, suspend, or discontinue any integration, or any part of the Service, at Our discretion. We are not responsible for a Health Platform's or a third-party device's failure to record data, for gaps or duplicates in what it provides, or for any consequence of relying on it.

You are solely responsible for evaluating the suitability of this information before relying on it, and Section 4 applies to all of it.

7. Subscriptions and Billing

Subscriptions are billed through the Apple App Store or Google Play. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period.

Free trials. If We offer a free trial, Your subscription begins as a free trial and automatically converts to a paid, auto-renewing subscription at the end of the trial unless You cancel at least 24 hours before the trial ends. Payment is charged to Your App Store or Google Play account at confirmation of purchase or at the end of the trial. If You purchase a subscription during a free trial, any unused portion of the trial is forfeited.

To cancel (iOS): Settings → [Your name] → Subscriptions → moonbelt → Cancel Subscription.
To cancel (Android): Google Play → Profile → Payments & Subscriptions → moonbelt → Cancel.

Refunds are governed by Apple's and Google's policies. Contact reportaproblem.apple.com (iOS) or Google Play (Android).

Deleting the app or Your account does not cancel Your subscription. Because billing is handled by Apple or Google, You must cancel through Your store account using the steps above, or You will continue to be charged.

Billing disputes. If You believe You have been charged in error, please contact support@moonbelt.ai within 30 days of the charge so that We can help resolve it. If You reverse a payment through a chargeback rather than through Apple's, Google's, or Our support process, We may suspend, downgrade, or terminate Your access to paid features.

8. User Content

8.1 Your Content and Our License

User Content remains Yours. You represent that You own or have the necessary rights to Your User Content. You grant Us a worldwide, royalty-free license (including the right to sublicense to the service providers who help Us operate the Service) to host, store, reproduce, process, analyze, and create derivative works from Your User Content in order to operate and improve the Service, including through the use of aggregated or de-identified data. We will not use Your identifiable User Content to train AI models without Your consent. This license ends when You delete Your User Content or Your account, except that it continues for (a) aggregated or de-identified data that no longer identifies You, (b) AI improvements already made with Your consent before deletion, and (c) Catalog Contributions and nutrition label photos, as described in Section 8.2.

8.2 Catalog Contributions (Shared Food Database)

When You log foods using photo scanning, voice logging, barcode or nutrition-label scanning, or the AI coach, generic food information derived from Your input (such as a food's name, nutrition details, and barcode) may be added to the Shared Food Database so that all users benefit from a richer catalog. Where the Service allows it, You may also submit photos of a food product and its packaging ("Product Photos") to illustrate an entry in the Shared Food Database. This generic food information and Product Photos are together Your "Catalog Contributions." Catalog Contributions do not include Your personal meal logs, meal photos, portion history, progress data, or notes, which remain private to Your account.

License. For Catalog Contributions, You grant Us a perpetual, irrevocable, worldwide, royalty-free, transferable, sublicensable license to host, store, reproduce, adapt, modify, create derivative works from, publish, publicly display, and distribute them as part of the Service, including to other users. Because other users may rely on entries in the Shared Food Database, this license survives deletion of Your User Content or Your account; upon deletion, Your Catalog Contributions are de-identified (unlinked from Your account) as described in Our Privacy Policy. You are not entitled to any compensation for Catalog Contributions.

Product Photo rules. By submitting a Product Photo, You represent and warrant that You took the photo Yourself (or otherwise hold all rights needed to grant the license above) and that it shows only the food product and its packaging: no people or faces, no personal information, and no unrelated third-party content.

Moderation. We may screen (including by automated means), hold, reject, edit, replace, deactivate, or remove any Catalog Contribution at any time, with or without notice. Submission does not guarantee publication, and a later submission (from You or another user) may replace an earlier one.

Nutrition label photos. When a barcode is not recognised and You photograph a product's nutrition label so the Service can read it, the values read from the label may become Catalog Contributions, and We keep the photo itself in private storage to verify and correct the catalog entry. We do not publish label photos or show them to other users. You grant Us a perpetual, irrevocable, worldwide, royalty-free license to store, reproduce, and use label photos for that purpose. This license survives deletion of Your account, and on deletion label photos are de-identified as described in Our Privacy Policy. Photograph only the label: no people or faces, and no personal information.

8.3 Reporting Content and Takedown

If You believe an entry or image in the Shared Food Database is inaccurate, inappropriate, or violates these Terms, report it through the app (where available) or by emailing support@moonbelt.ai. You may use the same address to request removal of a Product Photo You submitted. We review reports and remove or correct content at Our discretion.

Copyright complaints. If You believe content available through the Service infringes Your copyright, email legal@moonbelt.ai with: (a) identification of the copyrighted work; (b) where the allegedly infringing material appears in the Service; (c) Your contact information; (d) a statement that You have a good-faith belief the use is not authorized by the copyright owner, its agent, or the law; and (e) a statement, made under penalty of perjury, that the information in Your notice is accurate and that You are the copyright owner or authorized to act on the owner's behalf. We will review complaints, remove content We determine to be infringing, and may suspend or terminate the accounts of repeat infringers.

9. Prohibited Uses

You may not reverse engineer the Service; use it to build or assist a competing product; copy, reproduce, or imitate the design, user interface, layout, visual appearance, or "look and feel" of the Application; scrape or automate access; use the Service or its content to train any artificial intelligence or machine-learning model; upload malware or unlawful content; or circumvent subscription or authentication controls.

10. Intellectual Property

The Service, including its source code, design, user interface, layout, graphics, animations, icons, visual appearance and "look and feel", text, the moonbelt name and logo, and all related trademarks (but excluding User Content), is owned by OriginMind Inc. and its licensors and is protected by copyright, trademark, trade dress, and other intellectual property laws. No rights are transferred to You beyond the limited license to use the Application on Your devices.

You may not copy, reproduce, modify, republish, distribute, or create derivative works from any part of the Service, nor imitate its design, user interface, or branding in a manner likely to cause confusion or to trade on Our goodwill, without Our prior written permission. Nothing in these Terms grants You any right to use the moonbelt name, logo, or trademarks.

11. Termination

We may suspend or terminate Your access for violations of these Terms. Sections 4, 6, 8-10, and 12-15 survive termination.

12. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or accuracy.

13. Limitation of Liability

Our total liability for all claims is limited to the greater of (a) amounts You paid in the 12 months before the event, or (b) USD $100. We are not liable for indirect, incidental, or consequential damages, including loss of data or profits.

Time limit on claims. To the extent permitted by applicable law, any claim or proceeding arising out of or relating to the Service or these Terms must be commenced within one (1) year after the event giving rise to it, or it is permanently barred. Some jurisdictions do not allow this limitation, in which case it does not apply to You.

14. Indemnification

To the maximum extent permitted by law, You agree to defend, indemnify, and hold harmless OriginMind Inc. and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) Your access to or use of the Service; (b) Your User Content; (c) Your violation of these Terms; or (d) Your violation of any applicable law or the rights of any third party. We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by You, in which case You agree to cooperate with Our defense of that claim.

15. Governing Law and Arbitration

These Terms are governed by the laws of Ontario, Canada. Disputes involving Canadian, EEA, or UK residents will be resolved in Ontario courts.

US residents only: Disputes will be resolved through binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. Class actions are not permitted. You may opt out within 30 days of first accepting these Terms by emailing legal@moonbelt.ai with subject line "Arbitration Opt-Out."

16. Apple App Store: Additional Terms

These additional terms apply when You download the Application from the Apple App Store. You and We acknowledge that these Terms are concluded between You and OriginMind Inc. only, and not with Apple Inc. ("Apple"). OriginMind Inc., not Apple, is solely responsible for the Application and its content.

17. Changes to These Terms

We may update these Terms at any time. Material changes will be announced through the app or by email before taking effect. Continued use constitutes acceptance.
